New Medical Treatment Guidelines
In December 2010, new treatment guidelines went into effect that created limitations. These new rules do not allow extended palliative treatment, specifically treatment that makes you feel better as opposed to getting better. Medical treatment must be more than helpful. It must be a means to a cure. Simply stated, regularly scheduled, ongoing chiropractic treatments are no longer authorized.
Prior to the enactment, doctors made the decision on necessary treatments unless the costs exceeded $1,000. Now, a specific order and nature of treatment are dictated by rules and regulations before any surgery can occur. For any variance, a doctor must make a formal request in court.
These rules are a subject of great debate among both carriers and claimants. Questions have been raised and lawsuits have been filed over the board’s authority to change what an injured party is entitled to according to an existing statute allowing treatment due to injury.
